General German Freight Forwarders' Terms and Conditions (ADSp) 2017<\/h2>\n

We operate exclusively in accordance with the General German Freight Forwarders\u2019 Terms and Conditions (ADSp) 2017<\/a>. Please note that the ADSp 2017 contain liability provisions that differ from the applicable statutory provisions. We refer in particular to Sections 22\u201325 of the ADSp 2017. <\/p>\n

In Article 23, the ADSp 2017 limit statutory liability for damage to goods under Section 431 of the German Commercial Code (HGB)\u2014which is set at 8.33 SDR\/kg per claim or per incident\u2014to 1 million or 2 million euros, or 2 SDR\/kg, whichever amount is higher, and for multimodal transport involving maritime carriage, generally to 2 SDRs per kilogram. Please note that the ADSp 2017 contain liability provisions that deviate from the respective statutory standard provisions. We refer in particular to Sections 22\u201325 of the ADSp 2017. <\/p>\n \n

We work exclusively on the basis of the German Freight Forwarders\u2019 Standard Terms and Conditions 2017 (ADSp 2017). Please note that the ADSp 2017 contain liability provisions that deviate from the respective statutory standard provisions. We particularly refer to clauses 22\u201325 ADSp 2017.To close the gaps resulting from the ADSp 2017 and to eliminate possible ambiguities, the following is agreed:<\/p>\n\n

Supplement to Clause 11.2 ADSp 2017:<\/h3>\n\n

In the absence of any agreement, the loading or unloading time for road vehicles, regardless of the number of consignments per loading or unloading point, shall be as follows:<\/p>\n\n

  1. For goods loaded on pallets of any kind:\n
      \n
    1. up to ten Euro pallet spaces: maximum 30 minutes,<\/li>\n
    2. up to twenty Euro pallet spaces: maximum 60 minutes,<\/li>\n
    3. more than twenty Euro pallet spaces: maximum 90 minutes;<\/li>\n <\/ol><\/br>\n <\/li>\n
    4. In all other cases for goods (excluding bulk goods) with a transshipment weight of\n
        \n
      1. up to three tons: maximum 30 minutes,<\/li>\n
      2. up to seven tons: maximum 60 minutes,<\/li>\n
      3. more than seven tons: maximum 120 minutes.<\/li>\n <\/ol>\n <\/li>\n <\/ol>\n\n

        As demurrage within the meaning of \u00a7 412 (3) HGB, a fee of EUR 50.00 per commenced 30 minutes is agreed. <\/p>\n\n

        Clarification of Clause 19 ADSp 2017:<\/h3>\n\n

        It is clarified that set-off or retention against claims arising from the transport contract and related non-contractual claims is only permissible if the due counterclaim is undisputed, ready for decision, or has been legally established.<\/p>\n\n

        Supplement to Clause 30 ADSp 2017:<\/h3>\n\n

        The exclusive place of jurisdiction pursuant to Clause 30.3 sentence 1 ADSp 2017 is Darmstadt. Clause 30.3 sentence 2 ADSp 2017 remains unaffected. The Regional Court, Commercial Chamber, shall have functional jurisdiction irrespective of the amount in dispute. <\/p>\n\n

        The ADSp 2017 including these supplements are available for download on our homepage and will be provided to you upon request.<\/p>\n

        Insurance<\/h2>\n

        We have taken out SLVS-Plus freight insurance<\/strong> with Oskar Schunck KG<\/a>.<\/p>\n

        Our receivables are insured with ALLIANZ TRADE-Kreditversicherungs AG. Upon expiry of the payment deadline, the receivable(s) shall be assigned to the debt collection company ALLIANZ TRADE Forderungsmanagement GmbH by way of an independent dunning procedure. <\/p>\n

        Use of InformationAll information provided \u2013 including excerpts thereof \u2013 may only be further processed or otherwise published with the prior written consent of PSAFL Cargo Brokers GmbH. Under no circumstances shall it be permitted to disseminate the retrieved information online or via other media, or to use it for commercial purposes.
